These Terms of Service govern your access to and use of pahtwand's banking infrastructure platform and related services. Please read them carefully before using our services.
By accessing or using any pahtwand platform, API, or service, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, you must immediately discontinue use of all pahtwand services.
pahtwand provides banking infrastructure, embedded finance APIs, payment processing, and related financial technology services to businesses. Services are provided on a subscription or usage basis as specified in your executed order form or service agreement. pahtwand reserves the right to modify or discontinue features with reasonable notice.
You must register a business account with accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify pahtwand immediately at [email protected] if you suspect unauthorized access.
All fees are stated in your order form and are due in advance unless otherwise agreed in writing. Payments are non-refundable except as expressly provided herein or required by applicable law. Overdue amounts accrue interest at 1.5{7689b8d9f1218efdd37f5d3fd2be1f0f57fa5815fdabee689ea413c98a8198c8} per month or the maximum rate permitted by law, whichever is lower.
You agree not to use pahtwand services for any unlawful, fraudulent, or deceptive purpose, including money laundering, terrorism financing, or sanctions evasion. You must not reverse-engineer, resell, or sublicense pahtwand infrastructure without prior written consent. Violation of this section may result in immediate suspension.
All pahtwand software, APIs, trademarks, documentation, and related materials are the exclusive intellectual property of pahtwand and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the services solely as permitted by your agreement. No title or ownership is transferred to you.
pahtwand processes personal and financial data in accordance with its Privacy Policy, available at #/privacy. You represent that you have obtained all necessary consents to share data with pahtwand. Both parties agree to comply with applicable data protection legislation, including GDPR where applicable.
Each party agrees to keep the other's non-public business, technical, and financial information confidential and not to disclose it to third parties without prior written consent. This obligation survives termination of the agreement for a period of five (5) years.
pahtwand services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or uninterrupted availability. pahtwand does not warrant that the services will be error-free or that defects will be corrected.
To the maximum extent permitted by law, pahtwand's total aggregate liability to you for any claims arising out of or relating to these Terms shall not exceed the fees paid by you in the twelve (12) months preceding the claim. pahtwand is not liable for indirect, incidental, consequential, or punitive damages of any kind.
Either party may terminate the agreement with 30 days' written notice. pahtwand may terminate immediately if you breach these Terms or engage in conduct that poses legal, regulatory, or reputational risk. Upon termination, your access to services ceases and outstanding fees become immediately due.
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of England and Wales. You waive any objection to such jurisdiction.
pahtwand may update these Terms from time to time and will provide at least 30 days' notice of material changes via email or in-platform notification. Your continued use of the services after the effective date constitutes acceptance of the revised Terms.
